If you are a successful businessperson, you may be eligible to apply for migration to Australia under one of the 14 business skills visa categories.
You may be eligible to apply if you have had a successful business career and:

you own, or have an ownership interest in, a substantial business, or
-
you have been involved in senior management in a substantial business, or
-
you have conducted substantial investment activities.
Generally you will also require substantial personal assets (the amount varies according to the visa class) and be in a position to transfer some of these assets to Australia for the purposes of establishing a business or investing in Australia and for settlement in Australia.
You will also have to meet requirements as to your age at the time of application (which depends on the visa category and can be waived in exceptional circumstances) and English language skills. Certain visa categories have no English requirement.

If you are a successful businessperson, you may be eligible to apply for migration to Australia under one of the business skills visa categories.
As from 1 March 2003, most applicants for Business Skills visas have to undergo a two stage process leading to permanent residence. The first step is to apply for a Provisional Visa (in one of 6 visa categories) which grants temporary residence to you, your spouse and dependents. You may then apply for a Residence Visa after 2 years of business activity in Australia (provided you meet certain minimum requirements) or 4 years of investment in Australia.
If you are a high calibre business migrant you may be able to qualify for permanent residence from the outset, under the new Business Talent (Migrant) Class AV which came into effect on 1 March 2003. The visa grants permanent residence to you, your spouse and dependents.
Holders of temporary residence visas already conducting business in Australia may apply for permanent residence under the Business Skills visa categories of Established Business in Australia and Regional Established Business in Australia .

Who can I include in my application?
You may include your spouse and dependent children in your application. All persons included in the visa application must pass health and character checks.
"Spouse" includes de facto relationships where you have been living with your partner for at least 12 months. A "dependent" child is a natural or adopted child (of you or your spouse) younger than 18 years who is wholly and substantially in you or your spouse's daily care and control. Children 18 years and older, who are still dependent on you or your spouse for financial, psychological or physical support may also be included. A child who is married is no longer a dependent child.
Can I apply from inside or outside Australia?
Each visa has its own requirements as to where you can be at the time of lodging and where you MUST be at the time of decision. If the visa permits onshore application, you must hold the appropriate Australian temporary residence visa at the time of applying.
The changes which operate from 1 March 2003 open the doors to applicants who may not previously have qualified for a Business Skills visa under the points test – there is no points test for the new Provisional visa categories.
Applicants generally have to demonstrate a lower level of business activity than under the previous rules in order to be eligible for a Provisional visa.
Applicants for a Provisional Visa in one of the State / Territory Sponsored visa subclasses are not required to have any competency in English.
It may be more difficult, but not impossible, to qualify for a Provisional visa if you are 55 years of age and older.
Business skills visa applications are complex and require detailed submissions and documentary evidence to show that you comply with the requirements for your particular visa. Generally, you are assessed on the contents of your visa application and supporting documents.
Your visa application is therefore the key to your successful entry into Australia.
Visa application – management, preparation and submission

State / Territory sponsorship
If you have State/Territory sponsorship in one of the Provisional visa subclasses the criteria you have to satisfy for obtaining both the Provisional visa and subsequently the Residence visa, are lower.

The following visas are available for business migrants from 1 March 2003.
Provisional visas granting temporary residence can be upgraded to Residence visas (granting permanent residence) after 2 years of business activity or 4 years of investment in Australia.

The “Business Talent (Migrant)” visa grants permanent residence to business people who have had an outstanding business career and who have considerable assets to transfer to Australia. You undertake an obligation that you will obtain a substantial ownership interest in an eligible business in Australia.

Business Talent (Migrant) visa criteria

You must have obtained State/Territory sponsorship;

You must have had an overall successful business career;

You must be under 55 years of age – but this requirement may be waived if you can show that your proposed business will be of exceptional benefit to a State or Territory and that State or Territory agrees to sponsor you;

You and / or your spouse must have owned at least 10% in 1 or more qualifying businesses in 2 out of the last 4 years;

The net assets owned by you and your spouse in a qualifying business or businesses must have been at least AUD$400,000 in 2 out of the last 4 years;

The turnover of the qualifying business or businesses must have been at least AUD$3,000,000 in the best 2 of the last 4 years;

You and your spouse must have personal and business assets of a net value of at least AUD$1,500,000 available for transfer to Australia within 2 years after the grant of the visa;

You must not have been involved in business or investment activities considered unacceptable in Australia;

There is no English requirement to satisfy.

An application for a “Business Owner Provisional” visa requires a detailed submission and documentary evidence about your business career to date, your ownership interest in a qualifying business, your involvement in the management of the business and your total net assets in the business.
You must apply for this visa from outside Australia, but you may also apply from inside Australia in limited circumstances.
You undertake an obligation that you will obtain a substantial ownership interest in an eligible business in Australia. The Business Owner Provisional visa is valid for four years from the entry expiry date. You can apply for the Business Owner (Residence) visa , which grants permanent residence, after at least 2 years of business activity in Australia.
You must comply with the following criteria for the Business Owner (Provisional) visa.

A holder of a Business Owner (Provisional) visa can apply for the Business Owner (Residence) Visa, which grants permanent residence to you and the members of your family unit, after at least 2 years of business activity in Australia.

The net value of your assets in the business must be at least AUD$100,000 in the 12 months immediately before applying.

The business/es must have had an annual turnover of at least AUD$300,000 in the 12 months before applying.

The business must have employed at least 2 full time employees who are Australian citizens or permanent residents or New Zealand passport holders and who are not your relatives.

You and your spouse must have net business and personal assets of AUD$250,000 in Australia for the 12 months before applying.

You must have been in Australia for at least 1 of the 2 years before applying.

State/Territory Sponsored Business Owner Provisional visa criteria

You must be sponsored by a State or Territory;

You must have had an overall successful business career;

If you are over 55, the age requirement can be waived if you propose to establish a business that a State or Territory authority has determined will be of exceptional economic benefit to the State or Territory.

You and/or your spouse must have had an ownership interest in a business with an annual turnover of owned at least AUD$300,000 in 2 out of the last 4 years OR you must have been a senior manager as defined, in a qualifying business ;

You and your spouse must have personal and business assets of a net value of at least AUD$250,000 available for conducting or establishing a business in Australia and sufficient additional assets to settle in Australia;

You must not have been involved in business or investment activities considered unacceptable in Australia;

A holder of a State/Territory Sponsored Business Owner Provisional visa can apply for the State/Territory Sponsored Business Owner Residence Visa after at least 2 years of business activity in Australia. This visa grants permanent residence to you and the members of your family unit.

The Investor Provisional visa is valid until a date specified by the Minister. You can apply for permanent residence once you satisfy the requirements of the Investor (Residence) visa which grants permanent residence (i.e. after you have held the designated investment for the minimum period).
Investor (Provisional) visa requirements
An application for an Investor (Provisional) visa requires a detailed submission and documentary evidence about your business or investment management career and the value of your assets, including:

You must have an overall successful record of business or investment activities.

You must be under 45 years of age.*

You must have managed a qualifying business activity or an eligible investment activity for a total of 3 years, and must be able to demonstrate in your submission that you have a high level of management skill in either a business or investment activity.

You must have maintained direct and continuous involvement in managing a business in which you and/or your spouse had an ownership interest of at least 10%. Alternatively, you must have managed eligible investments of at least AUD$1,500,000 in 1 of the past 5 years.*

The value of the net assets of yourself and your spouse must be at least AUD$2,250,000.*

You are required to have made a designated investment of at least AUD$1,500,000 at the time the decision is made regarding your visa application. You should not make this investment until advised to do so by DIAC.

You should have vocational English.*

You have not been involved in business or investment activities considered unacceptable in Australia.

You can apply for permanent residence if you have held the designated investment of $1,500,000 for at least 4 years, and you have been resident in Australia for 2 of the 4 years before applying.
Before applying for a State/Territory Sponsored Investor Provisional visa, you must first obtain sponsorship by an Australian State or Territory. An application for a visa under the “State/Territory Sponsored Investor (Provisional)” category requires a detailed submission and documentary evidence about your career and your management responsibilities in a major business to prove that you comply with the requirements.
You must have had a successful career in business or investment management, have significant personal assets and be prepared to make an investment of AUD$750,000 in an Australian government approved designated investment for a minimum period of 4 years.
State/Territory Sponsored Investor (Provisional) visa requirements
An application for a State/Territory Sponsored Investor (Provisional) visa requires a detailed submission and documentary evidence about your business or investment management career and the value of your assets, including:

You must show that you have obtained State or Territory sponsorship.

You must have an overall successful record of business or investment activities.

You must be under 55 years of age. If you are over 55, the age requirement can be waived if your proposed business is endorsed by your sponsoring State or Territory as of exceptional economic benefit to the State or Territory.

You must have managed a qualifying business activity or an eligible investment activity for a total of 3 years, and must be able to demonstrate in your submission that you have a high level of management skill in either a business or investment activity.

You must have maintained direct and continuous involvement in managing a business in which you and/or your spouse had an ownership interest of at least 10%. Alternatively, you must have managed eligible investments of at least AUD$750,000 in 1 of the past 5 years.
-
The value of the net assets of yourself and your spouse must be at least AUD$1,125,000.
-
You are required to have made a designated investment of at least AUD$750,000 at the time the decision is made regarding your visa application. You should not make this investment until advised to do so by DIMIA.

You have not been involved in business or investment activities considered unacceptable in Australia.

If you hold an Investor (Provisional) visa you can apply for permanent residence if you can demonstrate a realistic commitment to maintaining your business and investment activity in Australia.
You must have continued to hold the designated investment of AUD$750,000 for at least 4 years, and you have been resident in the sponsoring State or Territory for 2 of the 4 years before applying for permanent residence.
An application for a visa under the “established business in Australia” category requires a detailed submission and documentary evidence about your ownership interest in a qualifying business in Australia, the turnover of the business, your involvement in the management of the business and your total net assets and liabilities in Australia.
You may only apply for the subclass 845 Established Business in Australia visa if you are a holder of an Australian visitor, student or temporary resident visa at the time you apply. You must have owned at least 10% of a business in Australia during the 18 months immediately preceding your application.
You must show that you comply with the Established Business in Australia basic requirements and pass the Established business in Australia points test.
Established business in Australia visa - basic requirements
The established business in Australia – basic requirements include:

You must hold an ownership interest of at least 10% in 1 or more main businesses in Australia for 18 months before applying for the visa.

The total value of the net assets owned by you or your spouse in 1 or 2 main businesses in Australia must have been at least AUD$100,000 in the 12 months preceding your application.

The turnover of your main business must have been at least AUD$200,000 in the 12 months before you apply, or AUD$100,000 if you exported goods.
-
You must participate in the management of the business and your skills must have a fundamental effect on the operation of the business.
-
The net assets (business and personal) of you and your spouse in Australia must be at least AUD$250,000 in the 12 months before applying.
-
You must have had a successful overall business career.
-
You must hold a temporary visitor, student or temporary resident visa and you must have been in Australia for 9 of the 12 months before you apply.
-
You have not been involved in business or investment activities considered unacceptable in Australia.
-
You must score at least 105 points in the established business in Australia visa – points test.
The requirements for your total net assets and net assets in a main business are reduced where you are sponsored by a State or Territory government and apply for a subclass 846 visa under the State/Territory Sponsored Regional established business in Australia visa category.
Established business in Australia – points test
You obtain points for your age and language ability, the business attributes (turnover and employment based) of the businesses you manage and your net assets available to transfer to Australia. The pass mark is 105 points as at 1 December 2000. You should check the pass mark and criteria which apply at the time you lodge your application on www.immi.gov.au.

You may apply for the subclass 846 “State/Territory Sponsored regional established business in Australia visa” if you are a holder of business (long stay) visa at the time you apply.
You must have owned at least 10% of a business in a designated area in Australia and be sponsored by a State or Territory government business development agency.
You must also show that you comply with the State/Territory Sponsored regional established business in Australia visa - basic requirements and pass the State/Territory Sponsored regional established business in Australia visa - points test.
State/Territory Sponsored Regional Established Business in Australia visa - basic requirements
Before applying for a visa in this category, you must first obtain sponsorship of a State or Territory. You will be required to live in the sponsoring State or Territory and must establish or conduct your proposed business in that State or Territory. Once you have obtained sponsorship you can apply for your visa. An application for a visa under the “State/Territory Sponsored Regional Established Business in Australia” category requires a detailed submission and documentary evidence about your ownership interest in a qualifying business in a designated area in Australia, your involvement in the management of the business, your net business assets and your total net assets in Australia and confirmation that a State or Territory has sponsored you.
The basic requirements include:

You have been sponsored by a State or Territory government business agency.

You held an ownership interest of at least 10% in 1 or more main businesses in a designated area in Australia for 24 months before applying for the visa.

You were directly responsible for the day to day management and overall performance of the business for the 24 months before applying.

The net assets (business and personal) of you and your spouse in Australia exceeded AUD$200,000 in the 24 months before applying and included net assets in a business in a designated area of not less than AUD$75,000.

You have had a successful overall business career.

The annual turnover of your main business or businesses must have been at least AUD$200,000 in each of the 2 years before you apply, or AUD$100,000 per year if you exported goods.

You must hold a business (long stay) visa at the time of application.

You have been in Australia as a temporary resident for at least 12 months out of the 24 months before your application.

You have not been involved in business or investment activities considered unacceptable in Australia.
You must also score at least 105 points in the State/Territory Sponsored Regional Established Business in Australia points test, unless your sponsoring State or Territory indicates that there are exceptional circumstances which apply.

You obtain points for your age and language ability, the business attributes (turnover and employment based) of the businesses you managed and your net assets available to transfer to Australia and the fact that you are sponsored by a State or Territory. The pass mark is 105 points as at 1 December 2000. You should check the pass mark and criteria which apply at the time you lodge your application on www.immi.gov.au.
